My Medical Getaway Inc. / Mon Séjour Médical Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice, provide clinical recommendations, select providers based on a medical evaluation or replace the advice or assessment of a qualified healthcare professional.

All care, examinations, diagnoses, recommendations, treatments, clinical decisions, final medical pricing, timelines, availability, complications and outcomes remain exclusively the responsibility of the independent medical providers concerned.

 

2. Independent Medical Services

The medical services presented, mentioned or potentially coordinated are provided exclusively by independent physicians, clinics, hospitals, healthcare professionals or other independent medical providers.

My Medical Getaway Inc. / Mon Séjour Médical Inc. may facilitate certain steps, transmit information with the client’s consent and coordinate administrative or logistical steps, but does not control the decisions, acts, omissions, timelines, prices, availability, complications or outcomes of independent medical providers.

Information transmitted by an independent provider may be communicated to the client for informational purposes. My Medical Getaway Inc. / Mon Séjour Médical Inc. does not validate it as medical advice and does not convert it into a clinical recommendation.

 

3. Independent Providers and Third-Party Services

Physicians, clinics, hospitals, healthcare professionals, transportation providers, accommodation providers, agencies, insurers, interpreters, excursion providers or other providers related to the client’s journey are independent third parties.

They are not employees, mandataries, agents, representatives, medical partners or guarantors of My Medical Getaway Inc. / Mon Séjour Médical Inc.

Any agreement, service, billing, policy, availability, modification, cancellation, refund or responsibility related to medical care or third-party services remains between the client and the independent provider concerned.

Non-medical services provided by third parties, including optional local transportation, accommodation, insurance, excursions, agencies, language assistance or other stay-related services, are subject to the terms, prices, availability, policies, insurance coverage, limitations and responsibilities of those independent providers.

When the arrival transfer between the airport and the accommodation is included in a coordination package, it remains provided by an independent transportation provider, subject to availability, schedules, terms, insurance coverage, policies and applicable limits.

 

4. Final Choice of Provider by the Client

My Medical Getaway Inc. / Mon Séjour Médical Inc. may present or facilitate introductions to certain facilities, clinics, physicians, healthcare professionals or independent providers, depending on the information provided by the client, the destination considered, communicated availability and the general nature of the request.

The final choice of provider always belongs to the client.

The client remains free to accept, refuse or consult any other provider of their choice.

My Medical Getaway Inc. / Mon Séjour Médical Inc. does not provide medical recommendations, does not select a provider based on a clinical evaluation, and does not guarantee the quality, outcome, availability, timelines, final medical pricing or medical result of services provided by an independent provider.

 

5. Client Decisions and Consent

The client remains responsible for their decisions regarding care, travel, insurance, required documents, selected providers and chosen services.

Before accepting any care, examination, procedure, treatment, price, timeline or proposed plan, the client must obtain the necessary information directly from the healthcare professional, clinic, hospital or independent provider concerned.

The client acknowledges that all medical care carries risks, that outcomes may vary and that no outcome, timeline, final price, availability, absence of complication or insurance reimbursement can be guaranteed by My Medical Getaway Inc. / Mon Séjour Médical Inc.

 

6. Separate Payments

My Medical Getaway Inc. / Mon Séjour Médical Inc. charges only its administrative and logistical coordination fees.

Medical fees, including consultations, examinations, procedures, treatments, medications, hospital fees, professional fees or other medical services, are established, billed and paid directly to the independent medical providers concerned.

Travel, optional local transportation, accommodation, insurance, excursion or other non-medical service fees are established, billed and paid according to the policies of the independent providers concerned, unless otherwise clearly provided in the coordination package.

My Medical Getaway Inc. / Mon Séjour Médical Inc. does not determine final medical prices and does not guarantee any refund, credit, postponement or cancellation of fees charged by an independent provider.

 

7. Limitation of Liability

To the extent permitted by applicable law, My Medical Getaway Inc. / Mon Séjour Médical Inc. shall not be liable for the acts, omissions, decisions, delays, errors, prices, changes, cancellations, refusals, outcomes, complications, damages or services provided by independent medical or non-medical providers.

My Medical Getaway Inc. / Mon Séjour Médical Inc. shall not be liable, in particular, for:

• clinical decisions, recommendations, treatments or medical outcomes;

• complications, adverse effects or unsatisfactory outcomes;

• timelines, availability, cancellations or postponements by an independent provider;

• differences between an estimate and the final price;

• decisions made by the client;

• fees, policies, refunds or credits applied by third parties;

• issues related to transportation, accommodation, insurance, excursions or tourism services;

• refusal of entry into a country, visa issues or administrative requirements;

• incomplete, inaccurate or late information provided by the client or by an independent provider.

This limitation is not intended to exclude any liability that cannot legally be excluded or limited under applicable laws.

 

8. No Guarantee

My Medical Getaway Inc. / Mon Séjour Médical Inc. does not guarantee:

• acceptance of a file by an independent provider;

• availability of a physician, clinic, hospital or service;

• a fixed response, assessment or appointment timeline;

• final medical pricing;

• absence of additional fees;

• a medical, clinical or aesthetic outcome;

• absence of complications;

• availability, punctuality or performance of a service provided by an independent third party;

• reimbursement by insurance;

• authorization to enter a foreign country.

 

9. Personal Information and Transfers Outside Place of Residence

As part of the requested coordination, My Medical Getaway Inc. / Mon Séjour Médical Inc. may collect, use, retain and transmit certain necessary personal information, including health information, to independent providers.

This information may be disclosed, accessed or processed outside the client’s province, state or country of residence, including outside Canada, when necessary for the requested coordination and in accordance with the required consents.

The collection, use, disclosure, transfer, retention and protection of personal information are described in the Privacy Policy of My Medical Getaway Inc. / Mon Séjour Médical Inc.

 

10. No Emergency Services

My Medical Getaway Inc. / Mon Séjour Médical Inc. does not provide emergency medical services.

In the event of a medical emergency, complication, concerning symptom or situation requiring immediate assistance, the client must immediately contact local emergency services, the medical facility concerned or a qualified healthcare professional.

My Medical Getaway Inc. / Mon Séjour Médical Inc. does not replace emergency services, physicians, hospitals, insurers or consular services.

 

11. U.S. Clients and HIPAA

If the client is located in the United States, the client understands that My Medical Getaway Inc. / Mon Séjour Médical Inc. is an administrative and logistical coordination company.

Unless otherwise expressly agreed in writing, My Medical Getaway Inc. / Mon Séjour Médical Inc. does not act as a covered entity or business associate within the meaning of the U.S. Health Insurance Portability and Accountability Act, commonly known as HIPAA.

Independent medical providers may be subject to their own legal, professional or regulatory obligations depending on their jurisdiction.

 

12. Governing Law and Jurisdiction

This notice is governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.

Subject to mandatory consumer protection rights, any dispute relating to the services of My Medical Getaway Inc. / Mon Séjour Médical Inc. shall be submitted to the competent courts of the Province of Québec.

 

13. Updates to This Disclaimer

My Medical Getaway Inc. / Mon Séjour Médical Inc. may update this notice to reflect changes to its services, practices or applicable legal requirements.

The version published on the website at the time of consultation is the version in effect.
