1. Purpose
These Terms of Service govern the use of the My Medical Getaway Inc. website and the administrative and logistical coordination services offered to clients.

They supplement, where applicable, the service agreement, privacy policy, cancellation and refund policy, and limitations and exclusions of liability published on our website.

 

2. Definitions
My Medical Getaway Inc.: a Canadian company offering administrative and logistical coordination services for planned medical travel abroad.
Client: any person who uses the website, forms or services of My Medical Getaway Inc.
Independent providers: physicians, clinics, hospitals, healthcare professionals, transportation providers, hotels, agencies, insurers, interpreters or other third parties involved in the client’s journey.
Services: administrative, documentation, language and logistical coordination services provided by My Medical Getaway Inc.

 

3. Nature of services — coordination only
My Medical Getaway Inc. acts only as an administrative and logistical coordination service. My Medical Getaway Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice or replace the assessment of a qualified healthcare professional.

All care, examinations, diagnoses, recommendations, treatments, medical pricing, timelines, availability and outcomes remain the sole responsibility of the independent medical providers concerned.

 

4. Use of the website and forms
The client agrees to use the website, forms and services honestly, accurately and in accordance with the instructions provided. The client agrees not to submit false, misleading, incomplete or unlawful information.

My Medical Getaway Inc. may limit, suspend or refuse a request in the event of misuse, suspected fraud, insufficient information or failure to comply with these terms.

 

5. Information questionnaire and sensitive information
The questionnaire may contain sensitive personal information, including health-related information.

Before submitting the questionnaire, the client must accept the privacy policy and provide the required consents for the collection, use, disclosure and, where applicable, transfer of their information to independent providers located in Québec, elsewhere in Canada or abroad.

Without the required consents, My Medical Getaway Inc. may be unable to continue the requested coordination.

 

6. Electronic communications
With the client’s consent, My Medical Getaway Inc. may communicate by email, SMS, phone or other appropriate means regarding the file, documents, confirmations, appointments, follow-ups and administrative information.

The client may withdraw certain communication consents. However, some administrative communications may remain necessary for the performance of the service, including receipts, confirmations, important notices and essential follow-ups.

 

7. Prices, currency and taxes
The prices for My Medical Getaway Inc.’s coordination services are displayed in Canadian dollars, taxes included, unless otherwise indicated.

Any equivalent amount in U.S. dollars is provided for reference only. The actual amount may vary depending on the applicable exchange rate, conversion fees and payment conditions at the time of the transaction.

My Medical Getaway Inc. may modify its prices at any time. The applicable price is the one displayed at the time of payment.

 

8. Payments and receipts
Payments for My Medical Getaway Inc. fees are made through a secure payment platform. My Medical Getaway Inc. does not store full payment card numbers.

A receipt or payment confirmation is sent to the client after the transaction.

 

9. Separation of coordination fees, medical fees and third-party services
Fees charged by My Medical Getaway Inc. cover only administrative and logistical coordination services.

Medical fees, including consultations, examinations, treatments, procedures, medications or other medical services, are established, billed and paid directly to the independent medical providers concerned.

Travel, transportation, accommodation, insurance, excursion or other non-medical service fees are also established, billed and paid according to the policies of the independent providers concerned.

 

10. Optional services and third-party services
Certain additional services may be offered upon the client’s request, on an optional basis and subject to availability, including coordination of local transportation, airport reception, accommodation, excursions or introductions to independent providers.

These services are provided by independent third parties according to their own availability, terms, policies, prices, insurance coverage, cancellation terms and responsibilities.

My Medical Getaway Inc. may facilitate coordination or introductions, but does not guarantee the availability, quality, continuity, pricing, schedules, compliance or performance of services provided by these third parties.

 

11. Timelines, availability and no guarantee
Response times, appointment timelines, reviews, transmissions, planning and receipt of documents depend on factors including file completeness, independent provider availability, processing times and circumstances beyond the control of My Medical Getaway Inc.

My Medical Getaway Inc. does not guarantee:

• a fixed appointment timeline;

• medical availability;

• a final medical estimate without provider assessment;

• a final medical price;

• a medical outcome;

• absence of complications;

• acceptance of a file by an independent provider.

 

12. Coordination standards
My Medical Getaway Inc. aims to provide structured, clear and traceable coordination. These standards are service objectives and not guarantees of results.

Coordination communications are mainly carried out by email, SMS or phone, depending on the file and the client’s consents.

My Medical Getaway Inc. aims to respond to administrative requests within a reasonable timeframe, depending on the complexity of the file, available information and responses expected from independent providers.

 

13. Prioritization and availability
My Medical Getaway Inc. may prioritize certain requests depending on the travel timeline, scheduled appointments or the administrative importance of a situation.

My Medical Getaway Inc. is not an emergency medical service. Services are offered according to its operational hours. Some communications outside regular hours may occur depending on coordination needs, without any commitment to continuous availability.

 

14. Client obligations
The client agrees to:

• provide accurate, complete and up-to-date information;

• submit requested documents within a reasonable timeframe;

• report any important change related to health, medication, availability, documents or travel;

• verify applicable travel, insurance, visa or entry requirements;

• obtain necessary medical information directly from the independent medical provider concerned.

My Medical Getaway Inc. may suspend, delay or limit coordination if information is insufficient, inconsistent, incomplete or not updated.

 

15. Emergencies
My Medical Getaway Inc. does not provide emergency medical services. In an emergency, the client must immediately contact local emergency services or go to the nearest medical facility.

 

16. File opening fee
The file opening fee covers the administrative start-up and initial processing of the file. This fee is non-refundable.

However, the file opening fee may be credited toward an eligible My Medical Getaway Inc. coordination package, according to the terms indicated at the time of purchase and for the corresponding file.

 

17. Cancellation, refund and credit
The cancellation, refund or credit conditions applicable to coordination packages and options, where applicable, are presented to the client before purchase or in the applicable policy.

Refunds related to independent providers, including medical centers, transportation providers, hotels, agencies, insurers or other third parties, are governed exclusively by those providers’ policies. My Medical Getaway Inc. is not responsible for refund, credit, postponement or cancellation decisions made by these third parties.

 

18. Postponements and changes
Postponements, changes or adjustments to appointments, services or travel arrangements depend on the availability, timelines and policies of the independent providers concerned.

Administrative fees from My Medical Getaway Inc. may apply when coordination steps have already been completed.

 

19. Limitations and exclusions of liability
The client acknowledges that My Medical Getaway Inc. acts only as an administrative and logistical coordinator.

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for the acts, omissions, decisions, delays, errors, prices, changes, cancellations, outcomes, complications or services provided by independent medical or non-medical providers.

This limitation is not intended to exclude any liability that cannot legally be excluded under applicable law.

 

20. Protection of personal information
The collection, use, disclosure, transfer, retention and protection of personal information, including health-related information, are governed by the My Medical Getaway Inc. privacy policy.

The client acknowledges that certain information may be disclosed to independent providers located outside Québec or Canada when necessary for the requested coordination and in accordance with the required consents.

 

21. U.S. clients and HIPAA
My Medical Getaway Inc. is an administrative and logistical coordination company. It is generally not a “covered entity” or “business associate” under the U.S. Health Insurance Portability and Accountability Act, commonly known as HIPAA.

Medical services, when provided, are provided exclusively by independent medical providers, according to their own policies, obligations and regulatory frameworks.

 

22. Intellectual property
The website content, including texts, visuals, trademarks, documents, logos, graphic elements and presentation structures, belongs to My Medical Getaway Inc. or its licensors.

It may not be copied, reproduced, adapted, distributed or used for commercial purposes without prior written authorization, except for strictly personal and non-commercial use.

 

23. Modification of terms
My Medical Getaway Inc. may modify these terms to reflect changes to its services, practices or applicable legal requirements.

The version published on the website at the time of consultation is the version in effect.

 

24. Governing law and jurisdiction
These terms are governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.

Subject to mandatory consumer protection rights, any dispute relating to the services of My Medical Getaway Inc. shall be submitted to the competent courts of the Province of Québec.
