1. Acceptance of Terms

By using the website, forms, services or communications of My Medical Getaway Inc. / Mon Séjour Médical Inc., the client acknowledges having read, understood and accepted these General Terms and Conditions of Service.

These terms apply to any request for information, file opening, submission of information, coordination, payment or use of services offered by My Medical Getaway Inc. / Mon Séjour Médical Inc.

 

2. Definitions

My Medical Getaway Inc. / Mon Séjour Médical Inc.: a Canadian company offering administrative and logistical coordination services for planned medical stays abroad.

Client: any person who uses the website, forms or services of My Medical Getaway Inc. / Mon Séjour Médical Inc.

Independent providers: physicians, clinics, hospitals, healthcare professionals, transportation providers, accommodation providers, agencies, insurers, interpreters or other third parties involved in the client’s journey.

Services: administrative, document-related, language and logistical coordination services provided by My Medical Getaway Inc. / Mon Séjour Médical Inc.

 

3. Nature of Services — Coordination Only

My Medical Getaway Inc. acts only as an administrative and logistical coordination service.

My Medical Getaway Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice, provide clinical recommendations, select providers based on a medical evaluation or replace the assessment of a qualified healthcare professional.

All care, examinations, diagnoses, recommendations, treatments, clinical decisions, final medical pricing, timelines, availability, complications and outcomes remain the sole responsibility of the independent medical providers concerned.

 

4. Independent Providers

Facilities, clinics, hospitals, physicians, healthcare professionals, transportation providers, accommodation providers, insurers, interpreters or other providers mentioned, presented or proposed are independent third parties.

My Medical Getaway Inc. does not control their acts, omissions, decisions, availability, timelines, prices, policies, insurance coverage, terms, outcomes or services.

The client acknowledges that any service provided by an independent provider is subject to that provider’s own terms, policies, availability, prices, insurance coverage, cancellation rules, limitations and responsibilities.

 

5. Information Questionnaire and Sensitive Information

The client may be invited to complete an information questionnaire to allow the initial administrative review of their request.

The client acknowledges that the information provided may include sensitive personal and health information.

Before submitting the questionnaire, the client must accept the Privacy Policy and provide the required consents for the collection, use, retention, disclosure and, where applicable, transfer of their information to independent providers, including outside their province, state or country of residence, and outside Canada.

The client is responsible for providing accurate, complete and up-to-date information. Incomplete, inaccurate or omitted information may delay, limit or prevent the processing of the file.

 

6. File Transmission

When the file is sufficiently complete and the required consents have been confirmed, My Medical Getaway Inc. may transmit certain information to an independent provider in order to allow the analysis of the request, the possible preparation of an estimate or the administrative and logistical coordination of the journey.

This transmission does not constitute a guarantee of file acceptance, availability, timeline, final pricing, treatment, outcome or medical feasibility.

 

7. Assessment by an Independent Provider

Any independent medical provider remains solely responsible for the medical analysis, assessment, recommendations, proposed care, required examinations, treatments, procedures, follow-up care, timelines, availability, complications, final medical pricing and outcomes.

My Medical Getaway Inc. may transmit to the client the information received from the independent provider, but does not validate it as medical advice and does not convert it into a clinical recommendation.

 

8. Separation of Responsibilities

The client understands that My Medical Getaway Inc. is responsible only for the administrative and logistical coordination services it provides directly.

Independent providers are responsible for their own services, acts, decisions, omissions, prices, timelines, policies, outcomes, complications and professional obligations.

My Medical Getaway Inc. may not be considered the employer, agent, representative, associate, medical partner or guarantor of any independent provider.

 

9. Separation of Coordination Fees, Medical Fees and Third-Party Services

Fees charged by My Medical Getaway Inc. relate only to administrative and logistical coordination services.

Medical fees, including consultations, examinations, treatments, procedures, medications, hospital fees, professional fees or other care-related fees, are established, billed and paid directly to the independent medical providers concerned.

Travel, optional local transportation, accommodation, insurance, excursion or other non-medical service fees are also established, billed and paid according to the policies of the independent providers concerned, unless otherwise clearly provided in the coordination package.

 

10. Optional Services and Third-Party Services

Certain additional services may be offered upon the client’s request, on an optional basis and subject to availability, including coordination of local transportation, accommodation, excursions or other services provided by independent third parties.

When the arrival transfer between the airport and the accommodation is included in a coordination package, it remains provided by an independent transportation provider, subject to availability, schedules, terms, insurance coverage, policies and applicable limits.

These services are provided by independent third parties according to their own availability, terms, policies, prices, insurance coverage, cancellation terms, limitations and responsibilities.

My Medical Getaway Inc. may facilitate certain introductions or coordination, but does not guarantee the quality, availability, price, safety, punctuality, outcome or performance of these third-party services.

 

11. Timelines, Availability and No Guarantee

My Medical Getaway Inc. does not guarantee:

• acceptance of a file by an independent provider;

• availability of a physician, clinic, hospital or other provider;

• response time or appointment timelines;

• a final or definitive medical estimate without provider assessment;

• final medical pricing;

• medical outcome;

• absence of complications;

• reimbursement by insurance;

• availability of transportation, accommodation, interpretation or third-party services;

• authorization to enter a foreign country.

Any timeline, price, availability or estimate communicated by an independent provider remains indicative, unless directly and expressly confirmed otherwise by that provider.

 

12. Final Choice of Independent Provider by the Client

My Medical Getaway Inc. may present or facilitate introductions to certain facilities, clinics, physicians, healthcare professionals or independent providers, depending on the information provided by the client, the destination considered, communicated availability and the general nature of the request.

The final choice of provider belongs to the client, who remains free to accept, refuse or consult any other provider of their choice.

My Medical Getaway Inc. does not provide medical recommendations, does not select a provider based on a clinical evaluation, and does not guarantee the quality, outcome, availability, timelines, final medical pricing or medical result of services provided by an independent provider.

 

13. Coordination Standards

My Medical Getaway Inc. aims to provide structured, clear and traceable administrative and logistical coordination.

These standards are service objectives and not guarantees of results, timelines, availability or acceptance by an independent provider.

Communications, reviews, transmissions or follow-ups are carried out according to the information available, consents received, reasonable timelines, provider availability and file complexity.

 

14. Prioritization and Availability

My Medical Getaway Inc. may prioritize certain files based on their stage of progress, completeness of information, intended travel timelines, provider availability or applicable administrative constraints.

My Medical Getaway Inc. is not an emergency medical service, an on-call medical service or a continuous medical assistance service.

Communications are handled according to the company’s operating hours and capacity, unless otherwise indicated.

 

15. Client Obligations

The client agrees to:

• provide accurate, complete and up-to-date information;

• submit required documents within the requested timelines;

• carefully review the information, estimates, terms and documents provided;

• verify applicable travel, insurance, visa, entry, vaccination or other formal requirements;

• verify directly with their insurer any possible reimbursement;

• comply with the policies, terms and instructions of independent providers;

• pay applicable fees according to the required terms;

• consult a qualified healthcare professional for any medical question.

The client remains responsible for their personal, medical, financial and travel decisions.

 

16. Emergencies

My Medical Getaway Inc. is not an emergency medical service.

In the event of a medical emergency, complication, concerning symptom or situation requiring immediate assistance, the client must contact local emergency services, the medical facility concerned or a qualified healthcare professional.

My Medical Getaway Inc. does not replace emergency services, physicians, hospitals, insurers or consular services.

 

17. File Opening Fee

A file opening fee may be required when submitting the questionnaire or before the initial review of the file.

The file opening fee covers administrative start-up and the initial administrative review of the file. This fee is non-refundable, unless otherwise required by applicable law.

Where indicated, this fee may be credited toward the coordination package if the client chooses to proceed with My Medical Getaway Inc.

 

18. Cancellation, Refund and Credit

Coordination fees paid to My Medical Getaway Inc. are subject to the cancellation, refund or credit terms indicated at the time of purchase or in the applicable policy.

Fees paid to independent providers are subject exclusively to the policies of those providers.

My Medical Getaway Inc. does not guarantee any refund of medical fees, travel fees, accommodation, transportation, insurance, excursions or any other third-party service.

 

19. Postponements and Changes

Postponements, changes or adjustments to appointments, services, travel arrangements, accommodation or other elements of the journey depend on the availability, timelines, terms and policies of the independent providers concerned.

Additional fees may apply according to the policies of independent providers or according to the additional coordination work required.

 

20. Limitations and Exclusions of Liability

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for the acts, omissions, decisions, delays, errors, prices, changes, cancellations, refusals, outcomes, complications, damages or services provided by independent medical or non-medical providers.

My Medical Getaway Inc. shall not be liable for losses, costs, damages, delays, travel changes, refusal of entry, medical complications, unsatisfactory results, cancellations, price differences, incomplete communications from a provider or decisions made by the client.

Nothing in these terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

 

21. Protection of Personal Information

The collection, use, retention, disclosure and protection of personal information are governed by the Privacy Policy of My Medical Getaway Inc. / Mon Séjour Médical Inc.

The client acknowledges that certain information may be disclosed to independent providers located outside their province, state or country of residence, including outside Canada, when necessary for the requested coordination and in accordance with the required consents.

My Medical Getaway Inc. applies reasonable confidentiality and security measures, but no system for transmitting or storing data can be guaranteed as fully secure.

 

22. U.S. Clients and HIPAA

For clients located in the United States, My Medical Getaway Inc. / Mon Séjour Médical Inc. acts as an administrative and logistical coordination service.

Unless otherwise expressly agreed in writing, My Medical Getaway Inc. / Mon Séjour Médical Inc. does not act as a covered entity or business associate within the meaning of the U.S. Health Insurance Portability and Accountability Act (HIPAA).

Independent medical providers may be subject to their own legal, professional or regulatory obligations depending on their jurisdiction.

 

23. Intellectual Property

The website content, including texts, images, logos, trademarks, documents, presentations, structures, graphic elements and downloadable content, belongs to My Medical Getaway Inc. / Mon Séjour Médical Inc. or its licensors, unless otherwise indicated.

Any unauthorized reproduction, copying, modification, distribution or use is prohibited.

 

24. Changes to These Terms

My Medical Getaway Inc. / Mon Séjour Médical Inc. may modify these General Terms and Conditions of Service at any time.

The applicable version is the version published on the website at the time the services are used, unless otherwise indicated.

The client is invited to review these terms regularly.

 

25. Applicable Law and Jurisdiction

These General Terms and Conditions of Service are governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.

Subject to any mandatory consumer protection laws, any dispute relating to these terms or to the services of My Medical Getaway Inc. / Mon Séjour Médical Inc. shall be submitted to the competent courts of Québec, Canada.
