1. Parties
This agreement is entered into between:
My Medical Getaway Inc. / Mon Séjour Médical Inc., a Canadian company offering administrative and logistical coordination services for planned medical stays abroad;
and
The client, meaning any person who uses the services, forms, communications or documents of My Medical Getaway Inc. / Mon Séjour Médical Inc.
 
2. Purpose of the Agreement
My Medical Getaway Inc. / Mon Séjour Médical Inc. provides administrative and logistical coordination services intended to facilitate the organization of a planned medical stay abroad, based on the information submitted by the client, the authorizations provided and the availability of the independent providers concerned.
This agreement is intended to clarify the role of My Medical Getaway Inc. / Mon Séjour Médical Inc., the limits of its services, the client’s responsibilities and the responsibilities of independent providers.

3. Nature of Services — Coordination Only
My Medical Getaway Inc. / Mon Séjour Médical Inc. acts only as an administrative and logistical coordination service.
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice, provide clinical recommendations, select providers based on a medical evaluation or replace the assessment of a qualified healthcare professional.
All care, examinations, diagnoses, recommendations, treatments, clinical decisions, final medical pricing, timelines, availability, complications and outcomes remain the sole responsibility of the independent healthcare professionals, clinics, hospitals or other medical providers concerned.
Travel, transportation, accommodation, excursions, insurance or other non-medical services, where applicable, are provided by independent third parties according to their own terms, policies, availability, prices, insurance coverage, limitations and responsibilities.

4. Description of Services
Depending on the client’s file and selected service, My Medical Getaway Inc. / Mon Séjour Médical Inc. may, among other things:

• organize and administratively review the client’s file;

• coordinate the secure transmission of certain information or documents;

• facilitate introductions to independent medical providers, without selecting a provider based on a clinical evaluation;

• coordinate appointment or planning requests, depending on availability communicated by independent providers;

• provide general information related to the administrative and logistical process;

• provide administrative and logistical information, useful documents or travel-related guides;

• coordinate certain requests related to transportation, accommodation, language assistance or other third-party services, where available and applicable.

My Medical Getaway Inc. / Mon Séjour Médical Inc. may refuse, suspend, delay or limit coordination if the information is insufficient, inconsistent, incomplete, not updated or if the necessary consents are not provided.

4.1 Final Choice of Independent Provider by the Client
My Medical Getaway Inc. / Mon Séjour Médical Inc. may present or facilitate introductions to certain facilities, clinics, physicians, healthcare professionals or independent providers, depending on the information provided by the client, the destination considered, communicated availability and the general nature of the request.
The final choice of provider belongs to the client, who remains free to accept, refuse or consult any other provider of their choice.
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not provide medical recommendations, does not select a provider based on a clinical evaluation, and does not guarantee the quality, outcome, availability, timelines, final medical pricing or medical result of services provided by an independent provider.

5. Client Obligations
The client agrees to:

• provide accurate, complete and up-to-date information;

• submit required documents within the requested timelines;

• inform My Medical Getaway Inc. / Mon Séjour Médical Inc. of any important change regarding their health condition, availability, contact details, documents or travel plans;

• carefully review the information, documents, estimates, policies and terms provided;

• verify applicable travel, insurance, visa, entry, vaccination or other document requirements;

• verify directly with their insurer any possible coverage or reimbursement;

• obtain necessary medical information directly from the independent medical provider concerned before accepting any care, examination, procedure, treatment, price, timeline or proposed plan;

• comply with the policies, terms, instructions and deadlines of independent providers;

• pay applicable fees according to the required terms;

• consult a qualified healthcare professional for any medical question.

The client remains responsible for their personal, medical, financial, administrative and travel decisions.

6. Consent, Privacy and International Transfers
The collection, use, disclosure, transfer, retention and protection of the client’s personal information, including certain health-related information, are governed by the Privacy Policy of My Medical Getaway Inc. / Mon Séjour Médical Inc.
The client acknowledges that, as part of the requested coordination, certain information may be disclosed, accessed or processed by independent providers located outside their province, state or country of residence, including outside Canada.
These jurisdictions may provide a different level of protection than that applicable in the client’s province, state or country of residence. My Medical Getaway Inc. / Mon Séjour Médical Inc. limits the information transmitted to what is reasonably necessary for the requested coordination and applies reasonable protection measures.
Without the required consents, My Medical Getaway Inc. / Mon Séjour Médical Inc. may be unable to continue the coordination.

7. Electronic Communications
With the client’s consent, My Medical Getaway Inc. / Mon Séjour Médical Inc. may communicate by email, SMS, phone or other appropriate means regarding the file, documents, confirmations, appointment requests, follow-ups and administrative or logistical information.
The client understands that certain electronic communications may involve confidentiality risks despite the reasonable protection measures in place.
The client may withdraw consent to electronic communications where permitted by applicable law, but understands that doing so may limit or prevent certain coordination steps.

8. Fees and Payments

8.1 Coordination Fees
My Medical Getaway Inc. / Mon Séjour Médical Inc. charges only administrative and logistical coordination fees.
These fees do not include medical, hospital, professional, travel, insurance, accommodation, optional local transportation, excursion or other third-party service fees, unless otherwise clearly provided in the selected package.
Payments made to My Medical Getaway Inc. / Mon Séjour Médical Inc. may be processed through secure third-party payment platforms. My Medical Getaway Inc. / Mon Séjour Médical Inc. does not store full payment card numbers.

8.2 File Opening Fee
Where a file opening fee applies, it covers the administrative start-up and initial administrative review of the file.
This fee is non-refundable, unless otherwise required by applicable law. However, it may be credited toward an eligible coordination package of My Medical Getaway Inc. / Mon Séjour Médical Inc., according to the terms indicated at the time of purchase and for the corresponding file.

8.3 Medical Fees
Medical fees, including consultations, examinations, treatments, procedures, medications, hospital fees, professional fees or other medical services, are established, billed and paid directly to the independent medical providers concerned, according to their own policies.
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not collect medical fees and does not determine final medical prices.

8.4 Third-Party Services and Options
Certain additional services may be offered upon the client’s request, on an optional basis and subject to availability, including coordination of local transportation, accommodation, excursions or other services provided by independent third parties.
When the arrival transfer between the airport and the accommodation is included in the selected coordination package, it remains provided by an independent transportation provider, subject to availability, schedules, terms, insurance coverage, policies and applicable limits.
These services are provided by independent third parties according to their own availability, prices, terms, insurance coverage, cancellation policies, refund policies, limitations and responsibilities.
My Medical Getaway Inc. / Mon Séjour Médical Inc. may facilitate coordination or introductions, but does not guarantee the availability, quality, continuity, pricing, schedules, compliance, safety, punctuality or performance of services provided by these third parties.

9. Local Transportation and Other Optional Services
When a local transportation service is requested, My Medical Getaway Inc. / Mon Séjour Médical Inc. acts only as an administrative coordinator between the client and an independent transportation provider, where available.
The arrival transfer between the airport and the accommodation may be included in the selected coordination package when expressly stated. Other local transfers, including transportation between the accommodation and certain appointments, may be coordinated as an optional service depending on the selected path, availability and the conditions of independent transportation providers.
Referrals or introductions to third-party providers, including agencies, accommodation providers, insurers, excursions or other suppliers, are optional and offered upon the client’s request, where available. Any booking, confirmation, payment, change, cancellation or refund remains exclusively governed by the relevant third party and its own terms.

10. Cancellation, Postponements and Changes
Cancellations, postponements or changes requested by the client may result in fees or be subject to certain restrictions, depending on the stage of the file, services already provided, terms applicable to the coordination package and policies of the independent providers concerned.
Postponements or changes to appointments, services, travel arrangements, accommodation or other elements of the journey depend on the availability, timelines, terms and policies of the independent providers concerned.
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not guarantee that a requested change can be accepted or completed.

11. No Guarantee — Timelines, Availability, Pricing and Outcomes
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not guarantee:

• acceptance of the file by an independent provider;

• availability of a physician, clinic, hospital or other provider;

• response time or appointment timelines;

• a final or definitive estimate without assessment by the provider concerned;

• final medical pricing;

• medical outcome;

• absence of complications;

• reimbursement by insurance;

• availability of transportation, accommodation, interpretation or third-party services;

• continuity, safety, punctuality or performance of a service provided by an independent third party;

• authorization to enter a foreign country.

Timelines, availability, final medical prices, recommendations, clinical decisions, complications and outcomes depend, among other factors, on independent providers, medical assessment, file completeness, required examinations, selected destination and circumstances beyond the control of My Medical Getaway Inc. / Mon Séjour Médical Inc.

12. Medical Emergencies
My Medical Getaway Inc. / Mon Séjour Médical Inc. is not an emergency medical service.
In the event of a medical emergency, complication, concerning symptom or situation requiring immediate assistance, the client must contact local emergency services, the medical facility concerned or a qualified healthcare professional.
My Medical Getaway Inc. / Mon Séjour Médical Inc. does not replace emergency services, physicians, hospitals, insurers or consular services.

13. Limitations and Exclusions of Liability
The client acknowledges that My Medical Getaway Inc. / Mon Séjour Médical Inc. acts only as an administrative and logistical coordinator.
To the extent permitted by applicable law, My Medical Getaway Inc. / Mon Séjour Médical Inc. shall not be liable for the acts, omissions, decisions, delays, errors, prices, changes, cancellations, refusals, outcomes, complications, damages or services provided by independent medical or non-medical providers.
My Medical Getaway Inc. / Mon Séjour Médical Inc. shall not be liable for losses, costs, damages, delays, travel changes, refusal of entry, medical complications, unsatisfactory results, cancellations, price differences, incomplete communications from a provider or decisions made by the client.
Nothing in this agreement is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

14. U.S. Clients and HIPAA
If the client is located in the United States, the client understands that My Medical Getaway Inc. / Mon Séjour Médical Inc. is an administrative and logistical coordination company.
Unless otherwise expressly agreed in writing, My Medical Getaway Inc. / Mon Séjour Médical Inc. does not act as a covered entity or business associate within the meaning of the U.S. Health Insurance Portability and Accountability Act, commonly known as HIPAA.
Independent medical providers may be subject to their own legal, professional or regulatory obligations depending on their jurisdiction.

15. Intellectual Property
Texts, documents, guides, forms, structures, content, trademarks, logos, visual elements, presentations and tools transmitted or made available by My Medical Getaway Inc. / Mon Séjour Médical Inc. remain its property or the property of its licensors, unless otherwise indicated.
The client may not copy, reproduce, modify, distribute or use them for commercial purposes without prior written authorization.

16. Governing Law and Jurisdiction
This agreement is governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.
Subject to mandatory consumer protection rights, any dispute relating to the services of My Medical Getaway Inc. / Mon Séjour Médical Inc. shall be submitted to the competent courts of the Province of Québec.

17. Acceptance
By using the services of My Medical Getaway Inc. / Mon Séjour Médical Inc., submitting a form, paying fees or confirming their agreement, the client acknowledges that they:

• have read, understood and accepted this agreement;

• understand that My Medical Getaway Inc. / Mon Séjour Médical Inc. acts only as an administrative and logistical coordination service;

• understand that medical care is provided exclusively by independent medical providers, who remain responsible for care, clinical decisions, timelines, final medical pricing, complications and outcomes;

• understand that the final choice of provider belongs to them;

• understand that certain optional or non-medical services may be provided by independent third parties according to their own terms, policies, availability, prices, insurance coverage, limitations and responsibilities.
