1. Parties

This service agreement is entered into between:

My Medical Getaway Inc.
and
the client, meaning the person who uses the services, completes a form, accepts the applicable terms or makes a payment.

By checking the acceptance box, submitting a form or making a payment, the client confirms that they have read, understood and accepted this agreement, as well as the documents incorporated by reference, including the terms of service, privacy policy, limitations and exclusions of liability and, where applicable, the cancellation and refund policy.

 

2. Purpose of the agreement

My Medical Getaway Inc. provides administrative and logistical coordination services intended to facilitate the organization of planned medical travel abroad, based on the information submitted by the client, the authorizations provided and the availability of the independent providers concerned.

 

3. Nature of services — coordination only

My Medical Getaway Inc. acts only as an administrative and logistical coordination service.

My Medical Getaway Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice or replace the assessment of a qualified healthcare professional.

All care, examinations, diagnoses, recommendations, treatments, medical pricing, timelines, availability and outcomes remain the sole responsibility of the independent healthcare professionals, clinics, hospitals or other medical providers concerned.

Travel, transportation, accommodation, excursions, insurance or other non-medical services, where applicable, are provided by independent third parties according to their own terms, policies and responsibilities.

 

4. Description of services

Depending on the client’s file and selected service, My Medical Getaway Inc. may, among other things:

• collect, organize and verify the administrative completeness of the information submitted;

• coordinate the secure transmission of certain documents or information, with the required consents;

• facilitate introductions to independent medical providers;

• coordinate appointment or planning requests, depending on communicated availability;

• provide information, useful documents or travel-related guides;

• offer non-clinical coordination support during the stay, depending on the selected itinerary.

My Medical Getaway Inc. may refuse, suspend, delay or limit coordination if the information is insufficient, inconsistent, incomplete, not updated or if the necessary consents are not provided.

 

5. Client obligations

The client agrees to:

• provide accurate, complete and up-to-date information, including health-related information necessary for the request;

• submit requested documents within a reasonable timeframe;

• inform My Medical Getaway Inc. of any significant change related to health, medication, availability, documents, travel or contact information;

• follow the instructions, timelines and steps necessary for coordination;

• verify applicable travel, insurance, visa, entry or document requirements;

• obtain necessary medical information directly from the independent medical provider concerned before accepting any care, examination, procedure or treatment.

The client acknowledges that the quality, feasibility and speed of coordination depend, among other factors, on the completeness of the file, the client’s responses, the policies of independent providers and their processing times.

 

6. Consent, privacy and international transfers

The collection, use, disclosure, transfer, retention and protection of the client’s personal information, including certain health-related information, are governed by the My Medical Getaway Inc. privacy policy.

The client acknowledges that, as part of the requested coordination, certain information may be disclosed, accessed or processed by independent providers located outside Québec or Canada.

These jurisdictions may provide a different level of protection than that applicable in Québec or Canada. My Medical Getaway Inc. limits the information transmitted to what is reasonably necessary for the requested coordination and applies reasonable protection measures.

Without the required consents, My Medical Getaway Inc. may be unable to continue the coordination.

 

7. Electronic communications

With the client’s consent, My Medical Getaway Inc. may communicate by email, SMS, phone or other appropriate means regarding the file, documents, confirmations, appointments, follow-ups and administrative information.

The client may withdraw certain communication consents. However, some administrative communications may remain necessary for the performance of the service, including receipts, confirmations, important notices and essential follow-ups.

 

8. Fees, payment and separation of payment flows

8.1 Coordination fees

My Medical Getaway Inc. charges only administrative and logistical coordination fees.

Prices for coordination services are displayed in Canadian dollars, taxes included, unless otherwise indicated. Any equivalent amount in U.S. dollars is provided for reference only and may vary depending on the applicable exchange rate, conversion fees and payment conditions at the time of the transaction.

Payments are processed through a secure payment platform. My Medical Getaway Inc. does not store full payment card numbers.

8.2 File opening fee

Where a file opening fee applies, it covers the administrative start-up and initial processing of the file.

This fee is non-refundable. However, it may be credited toward an eligible My Medical Getaway Inc. coordination package, according to the terms indicated at the time of purchase and for the corresponding file.

8.3 Medical fees

Medical fees, including consultations, examinations, treatments, procedures, medications or other medical services, are established, billed and paid directly to the independent medical providers concerned, according to their own policies.

My Medical Getaway Inc. does not collect medical fees and does not determine final medical prices.

8.4 Third-party services and options

Certain additional services may be offered upon the client’s request, on an optional basis and subject to availability, including coordination of local transportation, airport reception, accommodation, excursions or introductions to independent providers.

These services are provided by independent third parties according to their own availability, prices, terms, insurance coverage, cancellation policies, refund policies and responsibilities.

My Medical Getaway Inc. may facilitate coordination or introductions, but does not guarantee the availability, quality, continuity, pricing, schedules, compliance or performance of services provided by these third parties.

 

9. Local transportation and other optional services

When a local transportation service is requested, My Medical Getaway Inc. acts only as an administrative coordinator between the client and an independent transportation provider, where available.

Transportation may include, depending on the selected itinerary and confirmed availability, certain transfers related to the stay, such as airport reception or transportation to certain appointments.

The independent transportation provider remains solely responsible for the performance of the transportation service, including its vehicles, drivers, schedules, insurance, terms, delays, cancellations, incidents or changes.

Referrals or introductions to third-party providers, including agencies, hotels, insurers, excursions or other suppliers, are optional and offered upon the client’s request, where available. Any booking, confirmation, payment, change, cancellation or refund remains exclusively governed by the relevant third party and its own terms.

 

10. Cancellation, postponements and changes

The applicable cancellation, postponement, credit or refund terms are those indicated in the terms of service and, where applicable, in the cancellation and refund policy presented to the client before purchase.

The client acknowledges that coordination steps may be carried out as soon as the file is opened and that certain amounts may become non-refundable depending on the stage of the file, the work already completed and the policies of the independent providers concerned.

Postponements or changes to appointments, services or travel arrangements depend on the availability, timelines and policies of the independent providers concerned. Administrative fees from My Medical Getaway Inc. may apply when coordination steps have already been completed.

11. No guarantee — timelines, availability, pricing and outcomes

The client acknowledges that My Medical Getaway Inc. does not guarantee:

• obtaining an appointment within a specific timeframe;

• the availability of a medical or non-medical provider;

• acceptance of a file by an independent provider;

• a final medical price;

• a final estimate without assessment by the provider concerned;

• a clinical or medical outcome;

• absence of complications;

• the continuity or performance of a service provided by an independent third party.

Timelines, availability, medical prices, recommendations and outcomes depend, among other factors, on independent providers, medical assessment, file completeness, required examinations, selected destination and circumstances beyond the control of My Medical Getaway Inc.

 

12. Emergencies

My Medical Getaway Inc. does not provide emergency medical services.

In an emergency, the client must immediately contact local emergency services or go to the nearest medical facility.

 

13. Limitations and exclusions of liability

The client acknowledges that My Medical Getaway Inc. acts only as an administrative and logistical coordinator.

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for the acts, omissions, decisions, delays, errors, prices, changes, cancellations, outcomes, complications or services provided by independent medical or non-medical providers.

This limitation is not intended to exclude any liability that cannot legally be excluded under applicable law.

The applicable limitations and exclusions are also described in the “Limitations and Exclusions of Liability” document, incorporated into this agreement by reference.

 

14. U.S. clients and HIPAA

If the client is located in the United States, the client understands that My Medical Getaway Inc. is an administrative and logistical coordination company.

My Medical Getaway Inc. is generally not a “covered entity” or “business associate” under the U.S. Health Insurance Portability and Accountability Act, commonly known as HIPAA.

Medical services, when provided, are provided exclusively by independent medical providers, according to their own policies, obligations and regulatory frameworks.

 

15. Term and termination

This agreement takes effect upon online acceptance, form submission or applicable payment, as the case may be.

It remains in effect until the file is closed, the applicable coordination services are completed, the agreement is terminated or the service relationship ends in accordance with the applicable terms of service and policies.

 

16. Governing law and jurisdiction

This agreement is governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.

Subject to mandatory consumer protection rights, any dispute relating to the services of My Medical Getaway Inc. shall be submitted to the competent courts of the Province of Québec.

 

17. Acceptance

By checking the acceptance box, submitting a form or making a payment, the client confirms that they:

• have read, understood and accepted this agreement;

• accept the terms of service, privacy policy and limitations and exclusions of liability;

• understand that My Medical Getaway Inc. acts only as an administrative and logistical coordination service;

• understand that medical care is provided exclusively by independent medical providers;

• understand that medical fees are established, billed and paid directly to the independent medical providers concerned;

• understand that certain optional or non-medical services may be provided by independent third parties according to their own terms.
