LIMITATIONS AND EXCLUSIONS OF LIABILITY — My Medical Getaway Inc. (MMG)

1. Scope of this document

This document describes certain limitations and exclusions of liability applicable to the use of the My Medical Getaway Inc. website and to the administrative and logistical coordination services offered to clients.

It supplements, where applicable, the service agreement, terms of service, privacy policy and cancellation and refund policy.

2. Role of My Medical Getaway Inc. — coordination only

My Medical Getaway Inc. acts only as an administrative and logistical coordination service.

My Medical Getaway Inc. does not provide medical care, make diagnoses, prescribe treatments, provide medical advice or replace the assessment of a qualified healthcare professional.

Any clinical decision, medical recommendation, assessment, treatment, procedure, medical price, medical timeline, availability or outcome remains the sole responsibility of the independent healthcare professionals, clinics, hospitals or other medical providers concerned.

3. Responsibility of independent providers

Medical services, including consultations, examinations, procedures, prescriptions, follow-ups, medications or other healthcare services, are provided exclusively by independent medical providers.

Non-medical services, including transportation, accommodation, excursions, insurance, agencies, interpretation or other services related to the stay, where applicable, are provided by independent third parties according to their own terms, policies, availability, pricing and responsibilities.

Each independent provider acts in its own name and under its own responsibility. My Medical Getaway Inc. does not control the acts, omissions, decisions, practices, timelines, availability, pricing, policies or outcomes of these providers.

4. Local transportation and optional services

When local transportation is requested, My Medical Getaway Inc. acts only as an administrative coordinator between the client and an independent transportation provider, where available.

My Medical Getaway Inc. does not act as a carrier, operator, mandatary, agent or contracting party for the transportation service provided by a third party.

The independent transportation provider remains responsible for the performance of the transportation service, including its vehicles, drivers, schedules, insurance, terms, delays, cancellations, incidents or changes.

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for losses, damages, delays, incidents, cancellations or disputes related to transportation services provided by an independent third party.

5. Referrals, introductions and other options

Referrals, links, contact information or introductions to third-party providers, including agencies, hotels, insurers, transportation providers, excursions, interpreters or other suppliers, are optional and offered upon the client’s request, where available.

My Medical Getaway Inc. may facilitate an introduction or administrative coordination, but does not provide these third-party services.

Any booking, purchase, payment, confirmation, change, cancellation, refund, warranty, insurance or responsibility related to these options remains exclusively governed by the relevant third party and its own terms.

6. No guarantee — timelines, availability, pricing and outcomes

My Medical Getaway Inc. does not guarantee:

• obtaining an appointment within a specific timeframe;

• the availability of a medical or non-medical provider;

• acceptance of a file by an independent provider;

• the final accuracy of an estimate before assessment by the provider concerned;

• a final medical price;

• a clinical or medical outcome;

• absence of complications;

• the continuity or performance of a service provided by an independent third party.

Timelines, availability, pricing, recommendations, outcomes or decisions depend, among other factors, on independent providers, file completeness, medical assessment, selected destination, required documents and circumstances beyond the control of My Medical Getaway Inc.

7. Accuracy of information provided by the client

The client is responsible for the accuracy, completeness and updating of the information provided to My Medical Getaway Inc., including health-related information, documents, availability, contact information and travel information.

My Medical Getaway Inc. may suspend, delay or limit coordination if the information provided is insufficient, inconsistent, incomplete or not updated.

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for consequences resulting from inaccurate, incomplete or outdated information provided by the client.

8. Emergencies

My Medical Getaway Inc. does not provide emergency medical services.

In an emergency, the client must immediately contact local emergency services or go to the nearest medical facility.

9. Separation of payment flows

My Medical Getaway Inc. charges only its administrative and logistical coordination fees.

Medical fees, including consultations, examinations, procedures, treatments, medications or other medical services, are established, billed and paid directly to the independent medical providers concerned.

Travel, transportation, accommodation, insurance, excursion or other non-medical service fees are established, billed and paid according to the policies of the independent providers concerned.

My Medical Getaway Inc. is not responsible for the payment, cancellation, refund, pricing, availability or service delivery policies of independent providers.

10. Limitation of liability

To the extent permitted by applicable law, My Medical Getaway Inc. shall not be liable for damages, losses, costs, delays, cancellations, decisions, complications or consequences arising, in particular, from:

• the acts, omissions, decisions, pricing, timelines, policies or services of independent medical or non-medical providers;

• a refusal, postponement, change or cancellation of an appointment by an independent provider;

• a change in price, estimate, availability or planning by an independent provider;

• events beyond the reasonable control of My Medical Getaway Inc., including force majeure, decisions of authorities, transportation delays, technology failures, weather events, strikes or similar situations;

• the use or inability to use the website, forms, payment platforms or third-party technology services.

This limitation is not intended to exclude any liability that cannot legally be excluded under applicable law.

11. Informational content — no medical substitution

Any content provided by My Medical Getaway Inc., including website texts, guides, itineraries, informational documents, journey explanations or general communications, is provided for informational, administrative and organizational purposes only.

This content does not constitute medical advice, a diagnosis, a treatment recommendation, a prescription, a guarantee of outcome or a confirmation of medical feasibility.

The client should always consult the independent healthcare professional concerned for any medical question, clinical decision, treatment, procedure or care recommendation.

12. External links and technology services

The website may contain links to external websites or use third-party technology services, including payment, forms, communications, hosting or management tools.

My Medical Getaway Inc. does not control these external websites or services and is not responsible for their content, operation, policies, privacy practices, interruptions or terms of use.

13. Application of legally permitted limits

Certain laws or jurisdictions may limit or prohibit certain exclusions of liability. In such cases, these limitations and exclusions apply only to the maximum extent permitted by applicable law.

14. U.S. clients and HIPAA

If the client is located in the United States, the client understands that My Medical Getaway Inc. is an administrative and logistical coordination company.

My Medical Getaway Inc. is generally not a “covered entity” or “business associate” under the U.S. Health Insurance Portability and Accountability Act, commonly known as HIPAA.

Medical services, when provided, are provided exclusively by independent medical providers, according to their own policies, obligations and regulatory frameworks.

15. Governing law and jurisdiction

This document is governed by the applicable laws of the Province of Québec and the applicable federal laws of Canada.

Subject to mandatory consumer protection rights, any dispute relating to the services of My Medical Getaway Inc. shall be submitted to the competent courts of the Province of Québec.
